Terms and Conditions
As you read these terms and conditions, please note that:
"We", "our", "ourselves" and "us" means Sail Blue Planet.
"You", "your" and "yourself" means the person whose name appears on the booking form.
Evidence of Contract
The evidence of the contract between you and us is a completed booking form and the banking by us of your remittance.
Changes to your trip
You are not entitled to change the date and/or type of a trip reservation once confirmed. We will, however, make best efforts to accommodate changes for you if practical.
Cancellations and penalties
You may cancel your trip at any time subject to the following penalties which are to be paid to us:
Over 12 weeks before your course or cruise: 10% of the total fee
Between 4 and 12 weeks before your course or cruise: 20% of the total fee
Between 10 days and 4 weeks before your course or cruise: 50% of the total fee
Less than 10 days before your course or cruise: The total course/cruise fee
We reserve the right to cancel a course or cruise at any time. If we do so we shall return all monies paid by you to us in respect of the provision of the course or cruise.
Any cancellations brought about by Covid related issues which are out of our control, and not cancelled by either party, we reserve the right to offer you a booking at a later date, at no extra cost to you.
Payment
All trips must be fully paid for at least 30 days prior to the confirmed start date. A deposit of 40% of the total course or cruise fee is required to reserve your place on a course or cruise.
Prices and discounts
Our prices and discount offers are only applicable to bookings made directly with us via our website, bookings via third parties or agents may be subject to extra premiums. Cruises are six days at sea and seven nights aboard, and include all fuel and mooring fees, boat cleaning, and bed linen, but does not include towels or the skippers meals, except for the skippers BBQ evening. Sailing courses are run over five days and six nights aboard.
Where the majority of any booking falls into high season, invoicing will be at the high season rate, conversely where the majority of the booking falls into low season, invoicing will be at the low season rate.
General
You are solely responsible for complying with all laws, regulations, orders, demands and requirements of the country in which your trip will be provided. We shall not be liable in any way whatsoever to you in connection with obtaining necessary documents or complying with such laws, regulations, orders, demands, requirements or instructions, whether given orally or in writing or otherwise, or for the consequences to you resulting from your failure to obtain requirements or instructions.
Breakages
Any breakages or damage deemed to be caused by you or your guests on board, during your trip by your Captain, will be paid by you at local reasonable cost.
This does not apply to the sailing vessel’s hull or main fittings, but does include bedding and general things like kitchen ware, winch handles etc.
Health issues
You are responsible for advising us of ANY health issues you may be suffering from, including all forms mental illness,chronic obesity and the other health issues mentioned in the Medical Declaration. This is to ensure the safety and comfort of all persons on board. Most health issues are not normally a problem, provided you have first checked with your doctor, informing them that yachting can occasionally involve vigorous exercise.
You are also responsible for bringing with you a supply of any medication you might need for the entire duration of your trip.
Travel documents
You are responsible for obtaining, and must possess and have available for presentation as required all entry and exit, health and other documents required by laws, regulations, order, demands or requirements of the country in which your course or cruise will be provided. We reserve the right to refuse to provide a course or cruise to anyone who has not complied with, or whose documents do not appear to comply with, such applicable laws, regulations, orders, demands or requirements.
Changes to your course or cruise
We will always make best efforts to provide our trips as published. However, in circumstances of bad weather, operational difficulties, local strikes or other industrial actions or staff illness we reserve the right to make changes to the type of yacht, instructor / skipper and schedule of a course or cruise. We will always endeavour to provide a service of equal quality.
Conduct aboard sailing vessels
If in our reasonable opinion you conduct yourself aboard one of our vessels so as to endanger the vessel or any person or property on board, or behave in a disorderly manner or in a manner to which other clients may reasonably object, we may take such measures as we deem necessary to prevent continuation of such conduct including your removal from the vessel. You may be prosecuted for offences committed on board a vessel. You agree to abide by the orders of the Skipper/Instructor in command of the school vessel at all times.
Injury and death
We hereby make you aware that sailing is a potentially dangerous activity and we cannot be held responsible for any injury or death during one of our trips save for our responsibilities under the Merchant Shipping Act 1975 and the findings of any official enquiry held under the requirements of the same act.
COVID-19
Sail Blue Planet hereby confirms that it will establish and maintain all relevant health and safety protocols decreed by the Greek government in regards to protection from the COVID-19 virus in regards to how such protocols are applied aboard any commercial vessels Sail Blue Planet owns or operates.
Clients attending trips with Sail Blue Planet hereby agree to follow instructions and advice from our staff regarding COVID-19 safety protocols when aboard vessels operated by us.
Clients also agree that they attend trips with Sail Blue Planet at their own risk and excuse Sail Blue Planet of any liability arising from contracting the COVID-19 virus whilst aboard any vessel operated by the company.
Any cancellations brought about by governmental Covid travel restrictions which are out of our control, and not cancelled by either party, are not subject to a refund. We will instead reschedule the booking to a mutually agreed later date, at no extra cost to you.
Jurisdiction
Any dispute between you and us concerning or arising out of the provision by us of the course or cruise shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales.
